Terms of Service

These Terms govern your use of Falandia. By creating an account or using the service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Falandia.
1. The service
Falandia is a daily language-learning service: it provides short daily sentences in a target language (starting with European Portuguese), with translations, grammar notes, vocabulary, and audio, plus an archive and optional reminders. Features may change, improve, or be discontinued over time.
2. Eligibility
You must be at least 16 to use Falandia. By using it, you confirm you meet this requirement and that the information you give us is accurate.
3. Your account
- You're responsible for keeping your login secure and for activity under your account.
- Use a valid email; we may need to send you service-related messages.
- Tell us promptly (hello@falandia.com) of any unauthorised use.
- You can delete your account at any time in Settings.
4. Acceptable use
You agree not to:
- copy, scrape, bulk-download, resell, or redistribute Falandia's content (sentences, translations, grammar notes, audio) except for your own personal learning;
- reverse-engineer, disrupt, overload, or attempt to bypass security, rate limits, or access controls;
- use the service unlawfully, or to infringe others' rights;
- share your account or use automated means to access the service without our permission.
We may suspend or terminate accounts that breach these Terms.
5. Learning content & AI disclaimer
Falandia's lessons are AI-assisted and reviewed by a human, but language is nuanced and errors can occur. Content is provided for general learning purposes only and is not professional translation, certified language instruction, or advice you should rely on for legal, medical, official, or other important contexts. We teach European Portuguese (as spoken in Portugal) for the flagship pair. You use the content at your own discretion.
6. Plans & payments
Falandia is currently free. We may include sponsored or affiliate content in our communications, identified as appropriate. If we introduce paid plans (for example annual or lifetime access), the price and what's included will be shown to you at the point of purchase, and payment will be processed by our Merchant of Record, Paddle, who is the seller of record and handles billing and applicable taxes (their terms will also apply to the purchase). Renewal, cancellation, and refund terms — including any statutory right of withdrawal for EU consumers — will be set out at that time. (Legal review: expand this section with the specific billing, auto-renewal, cancellation and refund terms when paid plans launch.)
7. Intellectual property
Falandia and its content (including the brand, the curated content library, software, and design) are owned by Falandia or its licensors and are protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the service and its content for your own personal, non-commercial learning. All rights not expressly granted are reserved.
8. Your content & feedback
If you submit feedback, suggestions, or other input, you grant us a perpetual, royalty-free licence to use it to improve Falandia, with no obligation to you. Don't submit anything you don't have the right to share.
9. Third-party services
Falandia relies on third-party providers (e.g. authentication, email, payments, hosting). We're not responsible for third-party services, and your use of them may be subject to their own terms.
10. Availability & changes
We aim to keep Falandia available and accurate but provide it on an "as is" and "as available" basis. We may modify, suspend, or discontinue features at any time. We're not liable for unavailability, data loss beyond our reasonable control, or interruptions.
11. Disclaimers & limitation of liability
To the maximum extent permitted by law:
- the service and content are provided without warranties of any kind (express or implied), including fitness for a particular purpose or accuracy;
- we are not liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill;
- our total liability for any claim is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) EUR 50. (Legal review: confirm an appropriate cap.)
Nothing in these Terms excludes liability that cannot be excluded by law, including your mandatory statutory rights as a consumer.
12. Termination
You may stop using Falandia and delete your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the service or other users. Sections that by their nature should survive termination (e.g. IP, disclaimers, liability) will survive.
13. Changes to these Terms
We may update these Terms. We'll post the updated version with a new date and, for material changes, give reasonable notice (e.g. email or in-app). Continuing to use Falandia after changes take effect means you accept them.
14. Governing law & disputes
These Terms are governed by the laws of Portugal, and disputes will be subject to the competent courts of Portugal, without affecting any mandatory consumer-protection rights you have where you live (including, for EU consumers, the right to bring proceedings in your home country and to use the EU Online Dispute Resolution platform). (Legal review: confirm wording for your EU consumer base.)
